Change to the Regulation on Authorized Representatives in the General Directorate of Industrial Property

Decision of the Council of Ministers No. 317 of May 31, 2018, on Approval of the Regulation on Authorized Representatives in the General Directorate of Industrial Property | New Change

On 29.06.2022, the Council of Ministers approved the Decision no. 453 “For some amendments to the Decision No. 317 of May 31, 2018, on Approval of the Regulation on Authorized Representatives in the General Directorate of Industrial Property” (published on the Albanian official gazette no.98, dated 01.07.2022).
The abovementioned Regulation, as amended, aims to define the rules and procedures related to the representation in the General Directorate of Industrial Property (hereinafter “DPPI”) by the authorized representatives.

The Regulation provides that physical and legal persons, who do not have their residence or headquarters in the territory of the Republic of Albania, must appoint their representative for issues of industrial property, such as: trademarks, geographical indications, industrial designs and patents, who will to represent them during the procedures with DPPI.

While, persons who have permanent residence in the Republic of Albania or who carry out activities within its territory, may be represented in DPPI themselves or through other representatives who are not registered in this Directorate, but manage or are employed by this person. The new amendments replaced the words “Licensing” with “Certification” in the text of Regulation, as well as abrogated the provision related to the representation with DPPI by only natural and legal persons who are registered in the Register of authorized representatives maintained by the latter.
