{"id":712,"date":"2022-01-05T09:21:56","date_gmt":"2022-01-05T09:21:56","guid":{"rendered":"https:\/\/settinglaw.com\/?p=712"},"modified":"2022-01-11T10:22:59","modified_gmt":"2022-01-11T10:22:59","slug":"new-law-on-foreingers","status":"publish","type":"post","link":"https:\/\/settinglaw.com\/index.php\/2022\/01\/05\/new-law-on-foreingers\/","title":{"rendered":"New Law On Foreingers"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"712\" class=\"elementor elementor-712\" data-elementor-settings=\"[]\">\n\t\t\t\t\t\t\t<div class=\"elementor-section-wrap\">\n\t\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-f6af9b4 elementor-section-boxed elementor-section-height-default elementor-section-height-default parallax_section_no qode_elementor_container_no\" data-id=\"f6af9b4\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-6e8cb4f\" data-id=\"6e8cb4f\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-9e16ca0 elementor-widget elementor-widget-text-editor\" data-id=\"9e16ca0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"color: #000000;\">On 24.06.2021, the Albanian Parliament approved the law no.79\/2021 \u201c<em>On Foreigners<\/em>\u201d, (<em>New <\/em><em>Law<\/em>), which abolished the Law no.108\/2013.<\/span><\/p><p><span style=\"color: #000000;\">The New Law is partially aligned with the EU acquis, aiming to improve foreigners\u2019s regime of entry, stay, employment and exit the Republic of Albania.<\/span><\/p><p><span style=\"color: #000000;\">It provides for the improvement of the necessary instruments related to issuance of electronic visas online.<\/span><\/p><p><span style=\"color: #000000;\">However, no major\u00a0changes are made to visa types, which according to the New Law are the following:<\/span><\/p><h4><span style=\"color: #000000;\"><strong>Visas<\/strong><\/span><\/h4><p><span style=\"color: #000000;\"><strong><u>Type A:<\/u><\/strong>\u00a0Airport transit visa with one entry which allows the holder to stay at the international zone of the airport until the departure of the flight for the final destination.<\/span><\/p><p><span style=\"color: #000000;\"><strong><u>Type C:<\/u>\u00a0<\/strong>Short term staying visa which allows the holder to stay in the Albanian territory up to 90 days within 180 days.<\/span><\/p><p><span style=\"color: #000000;\"><strong><u>Type D:<\/u>\u00a0<\/strong>Long term staying visa valid for 1-year which allows the holder to stay in Albania up to 90 days within 180 days and to apply for the issuance of a residence permit.<\/span><\/p><p><span style=\"color: #000000;\">Foreigners entering the Republic of Albania without a visa may stay within the Albanian territory for a period of 90 days within 180 days from the first entry. The visa application from a foreigner should be submitted no more than 90 days before the scheduled date of his arrival in the Republic of Albania.<\/span><\/p><p><span style=\"color: #000000;\">Further, the New Law has made minor changes to residence and work permits types as well as the application procedures.<\/span><\/p><h3><span style=\"color: #000000;\">Residence Permits<\/span><\/h3><p><span style=\"color: #000000;\">Residence permits are required for all international citizens that need to stay in Albania for more than 90 days.<\/span><\/p><p><span style=\"color: #000000;\">According to the New Law, types of the residence permits issued form the Albanian border and migration authorities are the following:<\/span><\/p><p><span style=\"color: #000000;\"><strong><u>Type A:<\/u><\/strong>\u00a0not renewable residence permit which allows the holder to stay in the Republic of Albania for the validity period of the permit;<\/span><\/p><p><span style=\"color: #000000;\"><strong><u>Type B:<\/u><\/strong>\u00a0unique residence permit which allows the holder to stay in the Republic of Albania for the validity period of the permit, which is renewable;<\/span><\/p><p><span style=\"color: #000000;\"><strong><u>Type C:<\/u><\/strong>\u00a0unique permanent residence permit;<\/span><\/p><p><span style=\"color: #000000;\"><strong><u>Type Card Blue AL:<\/u>\u00a0<\/strong>unique residence permit issued to highly qualified employees, which is renewable;<\/span><\/p><p><span style=\"color: #000000;\"><strong><u>Type Card Blue AL-C:<\/u>\u00a0<\/strong>unique permanent residence permit issued to highly qualified employees.<\/span><\/p><p><span style=\"color: #000000;\">Also, some additions have been made to new terms related to \u201c<em>Au pair<\/em>\u201d foreigner, as key personnel and its categories, the motives of the unique residence permit referring to \u201c<em>digital mobile employees\u201d<\/em>\u00a0which is initially issued for a term of up to 1- year.<\/span><\/p><p><span style=\"color: #000000;\">The application for a residence permit must be submitted within the first 30 days of residence in Albania and must be conforming to the purpose of the visa used for entering Albania.<\/span><\/p><h3><span style=\"color: #000000;\"><strong>Terms and duration of residence permits<\/strong><\/span><\/h3><p><span style=\"color: #000000;\">Residence permits are issued for a period of:<\/span><\/p><ul><li><span style=\"color: #000000;\">3 months, 6 months and 1-year (<em>renewable up to 5 consecutive times<\/em>);<\/span><\/li><li><span style=\"color: #000000;\">2 years (<em>renewable only once<\/em>);<\/span><\/li><li><span style=\"color: #000000;\">permanent, in case the foreigner has resided in Albania for more than 5 consecutive years and has strong ties and activity in Albania.<\/span><\/li><\/ul><p><span style=\"color: #000000;\">Pursuant to the New Law, citizens of USA, European Union and Kosovo can be provided with an initial residence permit for a term of 5 years.<\/span><\/p><p><span style=\"color: #000000;\">A foreigner provided with a residence permit must register his address of residence with the competent office of the respective local government unit. Failure to comply with such registration within the legal term, will result in the cancellation of the permit.<\/span><\/p><p><span style=\"color: #000000;\">Also, a foreigner provided with a residence permit, could stay outside the Albania territory for a period up to 180 days, for justified reasons upon a prior notification to the police office regarding the reasons for leaving Albania.<\/span><\/p><h3><span style=\"color: #000000;\"><strong>Unique Work Permits <\/strong><\/span><\/h3><p><span style=\"color: #000000;\">Foreigners working in the Republic of Albania, depending on the specific case, must be equipped with a unique work permit.<\/span><\/p><p><span style=\"color: #000000;\">The examination of application and issuance of the unique permit, when the general criteria set out in the law are met, is performed by the Albanian border and migration authorities within a period from 4 to 12 weeks.
