{"id":1,"date":"2022-01-05T12:31:52","date_gmt":"2022-01-05T12:31:52","guid":{"rendered":"http:\/\/settinglaw.com\/?p=1"},"modified":"2022-01-11T10:22:19","modified_gmt":"2022-01-11T10:22:19","slug":"changes-to-the-civil-procedure-code-of-the-republic-of-albania","status":"publish","type":"post","link":"https:\/\/settinglaw.com\/index.php\/2022\/01\/05\/changes-to-the-civil-procedure-code-of-the-republic-of-albania\/","title":{"rendered":"Changes to the Civil Procedure Code of the Republic of Albania"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"1\" class=\"elementor elementor-1\" data-elementor-settings=\"[]\">\n\t\t\t\t\t\t\t<div class=\"elementor-section-wrap\">\n\t\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-f6af9b4 elementor-section-boxed elementor-section-height-default elementor-section-height-default parallax_section_no qode_elementor_container_no\" data-id=\"f6af9b4\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-6e8cb4f\" data-id=\"6e8cb4f\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-9e16ca0 elementor-widget elementor-widget-text-editor\" data-id=\"9e16ca0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><span style=\"color: #000000;\">The Albanian Parliament approved the Law no. 44\/2021 \u201cOn additions and amendments to law no.8116, dated 29.03.1996 \u201c<em>Civil Procedure Code of the Republic of Albania<\/em>\u201d, coming into force on 29.05.2021. <\/span><\/p><p><span style=\"color: #000000;\">This law aiming to simplify the procedure of the examination of appeals before the Appeal Court and the Supreme Court.<\/span><\/p><p><span style=\"color: #000000;\"><strong>According to these amendments, the Appeal Court will examine the appeal on bases of submitted documents, in the counseling room, without the presence of the parties. Exceptionally, the Appeal Court may decide to examine the appeal in a judicial hearing with the presence of the parties, if:<\/strong><\/span><\/p><ul><li><span style=\"color: #000000;\">it is necessary to assess whether new facts or evidence should be submitted, according to article 465 of Civil Procedure Code; or<\/span><\/li><li><span style=\"color: #000000;\">there are issues on the matter of fact or law, on which parties have not previously submitted their statement of defense.<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><br \/><strong>Further, the Appeal Court may examine several cases with a single judge, such as:<\/strong><\/span><\/p><ul><li><span style=\"color: #000000;\">appeals related to disputes with a value up to twenty times of the national minimum salary, deriving from contractual obligations;<\/span><\/li><li><span style=\"color: #000000;\">appeals against the first instance court\u2019s decision that rejected to issue an enforcement order;<\/span><\/li><li><span style=\"color: #000000;\">appeals against the first instance court\u2019s decision that examined the claim for cancellation of bailiff actions, as well as other cases provided in the Civil Procedure Code.\u00a0<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><br \/>Moreover, this law changed the threshold for the disputes examined with a fast procedure (<em>i.e. from ALL 150.000 to twenty times of the national minimum salary<\/em>).<\/span><\/p><p><span style=\"color: #000000;\">Also, these amendments provide that parties may submit a special appeal to the Supreme Court against the Appeal Court\u2019s decision that has dismissed the case or sent the case back for retrial to the first instance court.<\/span><\/p><p><span style=\"color: #000000;\">Regarding the examination of the case before the Supreme Court, the law provides that it is performed based on written documents in the counseling room.<\/span><\/p><p><span style=\"color: #000000;\"><strong>Exceptionally, the Supreme Court may decide to examine the case in a judicial hearing, with the presence of the parties, if:<\/strong><\/span><\/p><ul><li><span style=\"color: #000000;\">the case is important in the context of uniform or develop the case law;<\/span><\/li><li><span style=\"color: #000000;\">it is considered necessary to hear the parties due to the complexity of the case, according to article 472 (b) and (c), as well as the second paragraph of the article 473\/a of Civil Procedure Code.<\/span><\/li><\/ul><p><span style=\"color: #000000;\"><br \/>Additionally, other law novelties with regard to the examination of the case before the Supreme Court are the following:<\/span><\/p><h4><span style=\"color: #000000;\"><strong><em>Pre-Trial Proceeding <\/em><\/strong><\/span><\/h4><p><span style=\"color: #000000;\">During the examination, the Supreme Court may decide to refer the case to the European Court of Human Rights or other international courts in accordance with international agreements ratified by the Republic of Albania. In that case, the examination in the Supreme Court will be suspended until a ruling by the international court.<\/span><\/p><h4><span style=\"color: #000000;\"><strong><em>Legal <\/em><\/strong><strong><em>opinion from the State Attorney and other entities<\/em><\/strong><strong><em>\u00a0 <\/em><\/strong><\/span><\/h4><p><span style=\"color: #000000;\">In case of the Unification and\/or change Of Case Law, the Supreme Court may require written opinion from the State Attorney, as well as from public or private legal entities having special knowledge on legal issues.
